PRIVACY POLICY

This Privacy Policy explains how the Company collects, uses, discloses and protects personal information of a Member in connection with Xcetra and the Verge.

It forms part of, and is to be read together with, the Terms and Conditions and the Payment Policy, in accordance with the precedence set out in Clause 16 of the Terms and Conditions.

By accepting the Terms and Conditions, a Member consents to the collection and processing described in this Policy.

1. Scope

This Privacy Policy explains how the Company collects, uses, discloses and protects personal information of a Member in connection with Xcetra and the Verge. It forms part of, and is to be read together with, the Terms and Conditions and the Payment Policy, in accordance with the precedence set out in Clause 16 of the Terms and Conditions.

2. Definitions

In this Privacy Policy, unless the context otherwise requires, the following terms have the meanings set out below:

Company
RRFX Infotech Private Limited, a company incorporated under the Companies Act, 2013, having its registered office at No.3/2, Basha Sahib Street, Pudupet, Chennai, Tamil Nadu – 600002, India.
Club or Xcetra
The run club operated by the Company under the brand name Xcetra, including all training sessions, group runs, coached programmes and events conducted under that brand at any location, including but not limited to Chennai and Bangalore.
Platform
The Verge mobile application and website through which registration, scheduling, communication and payment for the Club are administered.
Member
An individual who registers for, enrols in, or participates in any activity of the Club.
Membership Plan
The specific plan, package or drop in session selected by a Member, as listed on the Platform and priced in accordance with the Payment Policy.
Grievance Officer
The officer designated in Clause 11 of this document to receive and address complaints.

3. Information Collected

3.1 Identity and Contact Information

Name, phone number, email address, and emergency contact details provided at registration.

3.2 Health Information

Medical fitness declarations, pre existing conditions and injury history disclosed under Clause 6 of the Terms and Conditions. This is “sensitive personal data or information” under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 and is collected only with explicit consent.

3.3 Payment Information

The Company does not itself store card or bank account numbers. Payment details are collected and processed directly by the payment gateway named in the Payment Policy, and the Company receives only transaction status and a masked reference.

3.4 Usage Information

Attendance, performance metrics and location data recorded through the Platform during a session, where the Member has enabled the relevant device permissions.

4. Purpose of Processing

Information is processed to register and administer Membership Plans; assess fitness related risk under Clause 6 of the Terms and Conditions; process payments in accordance with the Payment Policy; communicate about sessions, schedule changes and events; and comply with applicable law.

6. Disclosure to Third Parties

  • 6.1The payment gateway named in the Payment Policy, solely to process transactions.
  • 6.2Coaches and run leaders, limited to health and emergency-contact information necessary for on-ground safety.
  • 6.3A government authority or court, where required by law.
  • 6.4The Company does not sell personal information and does not disclose health information for marketing purposes.

7. Storage, Retention and Security

Information is stored on servers located in India and protected by reasonable security practices and procedures as required under Section 43A of the Information Technology Act, 2000 and the Rules made thereunder. Health information is retained only for the duration of active membership and 12 (twelve) months thereafter, unless a longer period is required to defend a legal claim or by law, after which it is securely deleted.

8. Member Rights

A Member may request access to, correction of, or erasure of their personal information, and may lodge a grievance, by writing to the Grievance Officer at Clause 11. These rights are presently available under the Information Technology Act, 2000 and Rules made thereunder, and will extend to the further rights of access, correction, erasure, grievance redressal and nomination conferred by the Digital Personal Data Protection Act, 2023 as its provisions. This Policy will be updated to reflect those obligations as they take effect.

9. Minors

Where a minor Member is registered under Clause 3.1 of the Terms and Conditions, the consents in this Policy are given and may be exercised by the parent or legal guardian who countersigned the registration.

10. Cookies and Platform Analytics

The Verge app and website use cookies or equivalent identifiers for login sessions and basic usage analytics. These can be managed through device or browser settings; disabling them may limit certain Platform features.

11. Grievance Officer

The Company has designated the following Grievance Officer under Section 5 of the Information Technology Act, 2000 read with Rule 5(9) of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and in anticipation of the corresponding obligations under the Digital Personal Data Protection Act, 2023 as they come into force:

A complaint will be acknowledged within 2 (two) working days and, where practicable, resolved within 30 (thirty) days of acknowledgement.

12. Changes to this Policy

The Company may revise this Policy by posting an updated version on the Platform with a new date. Material changes will be notified to Members in the manner set out in Clause 15 of the Terms and Conditions.

13. Governing Law and Jurisdiction

This Policy is governed by the laws of India. The courts at Chennai, Tamil Nadu shall have exclusive jurisdiction over any dispute arising out of or in connection with this Policy, without prejudice to the grievance redressal process set out above.
